Frequently asked questions

Can an AI agent approve or deny requests in Ecuador?

It can assist, but if its decision produces legal effects for the person, the LOPDP (art. 20) lets them request a reasoned explanation and the criteria used. Design those cases with human review.

Who supervises data protection in Ecuador?

The Superintendency of Personal Data Protection, which publishes resolutions and guides and runs the National Personal Data Registry System (SISPDP).

What if the chatbot or agent exposes customer data?

The LOPDP requires notifying the Authority and ARCOTEL within five days at most (art. 43) and the data subject within three days if their rights are at risk (art. 46). Have a procedure ready before going to production.
